General Conditions for the purchase

These General Purchase Conditions apply to the purchase of the products that FansAbout OÜ (hereinafter “FansAbout”), sells through the website hosted at the URL www.sockerclub.es (the “Website”), to any user (“Customer”).

The purchase of the products offered through the Website implies the acceptance of the terms and conditions provided in these General Conditions of Purchase, therefore, before proceeding with their acceptance, read their content carefully. If you do not accept these General Conditions, the purchase of the products will not take place and, consequently, will not entail the assumption of any type of obligation or responsibility on the part of FansAbout.

By placing a purchase order through the Website, the Client declares that they are over 16 years of age and have the legal capacity to contract the products of the Website.

To place a purchase order, the Customer must follow each of the steps of the purchase procedure provided on the Website.

FansAbout reserves the right to modify the content and/or scope of the General Purchase Conditions at any time, without the need to communicate it or notify it in advance, so read its content carefully as it is the Customer’s responsibility to review the General Purchase Conditions before purchasing any product from the Website.

CUSTOMER REGISTRATION.

To start the procedure of purchasing the products of the Website, the Client must register in the “Register” section of the Website (or as a “guest”). In subsequent purchase processes, in the event that the Client has registered, it will only be necessary to provide their email address and password in the “My Account” section.

PRICE AND METHOD OF PAYMENT.

The price of the products will be the one that appears in the currency indicated next to each product on the Website.

Shipping costs are not included in the price of the products and are borne by the Customer as long as the order does not have free shipping costs. These shipping costs will be added to the total amount of the selected products so that the customer can consult them at any time in the shopping cart before confirming the order and finalizing the purchase process.

FansAbout reserves the right to make, at any time and without prior notice, the modifications it deems appropriate, being able to frequently update products or prices. The price applicable to the purchase request made by the Client will be the one that appears at the time of accepting the General Purchase Conditions.

The Client may pay for the products by any of the means of payment indicated below:

The customer is solely responsible for the accuracy of the information of his payment method, so FansAbout is not responsible for any loss that the customer may suffer as a result of incorrect information on the payment method provided.

The proof of purchase of the products will be available and can be viewed in the “My Account” section. From this section, the Customer can also download the invoice for the order. For any questions or requests about billing, you can contact our Customer Service department.

Once the purchase process is completed, an electronic confirmation will be generated.

FansAbout has high-security measures. Likewise, the payment process works on a secure server using the SSL Protocol (Secure Socket Layer). The secure server establishes a connection so that the information is transmitted encrypted using 128-bit algorithms, which ensure that it is only intelligible for the Client’s device. In this way, using the SSL protocol guarantees:

FansAbout has implemented a program to detect possible fraudulent operations and reserves the right to request additional information, confirmations and/or documents from the Client, even after having made one or more purchases through the Website, by phone call or email. , to confirm that the Client has effectively made and authorized said purchase and/or that the delivery or return of the same has been made correctly and in this way definitively authorizes the respective transaction.

FansAbout may make various verifications by telephone on the identity of the Customer, or request: (a) a written confirmation and authorization signed by the Customer responsible for the respective purchase; and (b) a copy of the valid official identification and photographs of the Client to confirm their identity. FansAbout undertakes to keep said information and documents with high-security measures, following current regulations.

If the Client does not respond favourably or does not deliver to FansAbout the documentation and information requested within 48 hours from the call or the sending of the email by FansAbout, the transaction detailed in said communication and the respective order may be cancelled, without the need for further notice or the responsibility of FansAbout, proceeding to reimburse the Customer for the amount paid for said purchase.

Said verification procedure is carried out for the safety of the Client and, therefore, by accepting these General Purchase Conditions, the Client agrees to submit to the procedure for detecting possible fraudulent operations referred to and authorizes FansAbout so that, once the Client Provide the information and additional documents referred to, these can be used for future purchases of the same Client.

PRODUCT DELIVERY.

Once FansAbout has verified that the purchase process has been carried out correctly, it will proceed to deliver the products to the address indicated by the Customer in the purchase procedure, during normal business hours and within the deadlines provided on the Website that, under no circumstances, In this case, it will be later than thirty (30) days following the Client’s acceptance of his order.

FansAbout may inform the Customer, by sending an email, of the departure date from the FansAbout warehouses of the order and the contact details of the transport company that will make the delivery.

The delivery will be made within an approximate period of 72 hours and will be considered made from the moment in which the product has been made available to the Customer at the place indicated by the Customer or at the corresponding collection point.

The risk of the products (among others, loss, impairment or theft) will pass to the Customer from the moment they have been made available to them.
If there were any incidence in the delivery of the products, FansAbout would inform the Client properly and immediately.

Delivery may be made through any of the following ways:

• To the address indicated by the Customer when making the purchase.

If the Customer, after making the purchase, wishes to modify the delivery address, he/she may do so as long as the order is “Processing”. FansAbout will not be responsible for errors and/or damages caused in the delivery when the address entered by the Customer does not exist, is incorrect or when the requirements for the change of delivery address indicated previously are not met. FansAbout may deliver the products in several shipments.

If at the time of delivery of the product to the address indicated by the Customer, the latter is absent or no one picks up the product, the Customer should contact FansAbout as soon as possible to arrange a new delivery date. If the delivery of the product to the Customer has not been made for reasons not attributable to FansAbout or the carrier, the products will be returned to FansAbout and the Customer will have to bear the shipping and return costs, as well as the possible associated management costs.

At the time of delivery of the product, the Client or the receiver must show an identification document to the carrier, verify the apparent condition of the packages and sign and write down the observations on the delivery note (in the format presented by the carrier). and apparent reserves at that time (for example, due to the lack of packages or apparent damage or manipulation in the Products or packaging). If the delivery note is in paper format, the Customer must request a copy of the delivery note from the carrier.

If, when opening the packages with the products, the Client sees that they are damaged due to transport, that they are wrong or that products are missing, they must notify FansAbout in writing within a period of five (5) calendar days from delivery, so that FansAbout can proceed promptly.

All product purchase orders are subject to availability. In case of unavailability of the contracted product, FansAbout will inform the Client of this and may offer him a product with similar characteristics of equal or higher quality, although the Client, alternatively, may cancel his purchase request and recover the amount paid in a maximum term of thirty (30) days.

WITHDRAWAL.

The Client has a period of fourteen (14) calendar days from the date of receipt of the product to exercise their right of withdrawal at no cost to the Client.
Notwithstanding the foregoing, the Client may not withdraw in the following cases:

a) Products made according to the Customer’s specifications or personalized.
b) Sealed products that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.

To exercise the right of withdrawal, the Customer must complete the Withdrawal Form and send the product to be returned together with the instructions, documents and packaging.

Once the right of withdrawal has been correctly exercised and, in any case, within a maximum period of fourteen (14) calendar days from receipt of the Withdrawal Form and the product, FansAbout will make the payment of the originally issued invoice and will return to the Customer the full amount of the purchase and delivery costs.

Next, we provide the model withdrawal form. Please note that the following form must only be completed and sent if the Client wishes to withdraw from the contract. I hereby inform you that I am withdrawing from my contract of sale of the following good / of the following goods:

RETURN.

Without prejudice to the right of withdrawal provided above, you will have 365 days from when you receive the order to make a return (or change of size).

In case of making the return from the Canary Islands or other non-EU parts of the world, the customs declaration (CN22 and/or CN23) must also be indicated on the outside of the package. Failure to comply with this step may result in the rejection of the merchandise by customs and its subsequent return to the sender.

Before returning an order, please make sure to contact the tax authorities in your country to confirm whether they will refund import taxes.

For the return, you can use the same box or envelope in which the product was sent, or failing that, in a similar format that guarantees the perfect condition of the product during shipping.

The right of return is subject to the following conditions:

• The products must be in the same condition that you received them, unused, in their box, packaging, with their original labels and without damage.
• The product return option does not apply to gift cards.

Once received, FansAbout will check in its warehouse the adequacy of the article, reserving the right not to make the refund in case of detecting that the purchased product and the returned product do not match or that the return has not been made following these General Conditions of purchase.

The cost of the return will be borne by the Customer except in those cases in which the product is defective. When shipping, it is advisable to use a shipping method that includes delivery confirmation. As soon as FansAbout receives the return in its warehouses, it will check that the product is correct and will process the corresponding payment. This process can take up to 14 calendar days and, if everything is correct, the returned product will be paid through the payment system used within a period of forty-eight (48) hours from the confirmation of arrival at the warehouse of the order.

The term of application of the refund of the amount will be up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards. In case of having made the payment by bank transfer, it will be necessary to provide an account number where to pay the amount to be returned and it may take two (2) business days to be reflected in the recipient bank.

Partial returns of an order will result in a refund of the price of the returned Product, but not the shipping costs.

When making a return, the only option available is to send the items to the indicated return address.

In the case of the return of defective products, the Customer will be entitled to a refund of the price, shipping costs and return transport costs, defective products or products delivered if they do not correspond to the order placed. by the Client, following applicable legislation.

COMPLAINTS AND CLAIMS.

The Client must contact FansAbout, through the means indicated at the beginning of the General Purchase Conditions, to express their complaints and claims, FansAbout committing to attend to them as soon as possible and, in any case, within a month from when are presented.

GUARANTEE.

The guarantee of the products sold through the Website will comply with the provisions of current legislation and, therefore, in general, FansAbout will respond to the lack of conformity expressed by the Client within a period of two (2) years from delivery of the products.

Specifically, if the product sold by FansAbout is not compliant, the Customer may choose between the repair or replacement of the product (unless one of these options is impossible or disproportionate) or between a price reduction or resolution of the contractual relationship following current legislation. In any case, the Client must inform FansAbout of the lack of conformity within a maximum period of two (2) months from when they became aware of it. FansAbout will assume the costs of returning the products in this type of case.

However, the foregoing, it will be understood that the products are compliant and, therefore, will be out of any guarantee when:

a) Damage or deterioration in the products sold by FansAbout occurs due to causes beyond the control of the manufacturer or FansAbout or, where appropriate, who acts under their responsibility (force majeure, accident, etc.) or as a consequence of an incorrect configuration and/or installation of the product by the Client; and
b) Damage or deterioration in the products sold is caused or originated by a component that has not been supplied by the manufacturer or FansAbout or is the result of alterations or repairs carried out by people other than the manufacturer or FansAbout or, where appropriate, by whom act at your own risk.

ONLINE DISPUTE RESOLUTION.

Following art. 14 of Regulation 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution in consumer matters, FansAbout informs Clients that they can submit their claims to the dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr

APPLICABLE LAW AND JURISDICTION.

The General Purchase Conditions shall be governed and interpreted following Estonian law.

If any conflict or discrepancy arises in the interpretation and/or application of the General Conditions, the competent Courts will be those established by the applicable regulations regarding the competent jurisdiction of consumers and users.
